By signing the order form and submitting this order to our company or representative, you confirm and affirm that you have read, understood and agree to these Terms and Conditions.
AppHouse UK Ltd reserves the right to, amend the Terms and Conditions for use and purchases. Amendments by AppHouse UK Ltd to the terms and conditions will only be effective on new orders. AppHouse UK Ltd will notify you of any material amendments to the Terms and Conditions, however, it is your responsibility to review the Terms and Conditions from time to time. Design Project Duration
Any indication given by AppHouse UK Ltd of an Application deployment duration is to be considered by the customer to be an estimation. AppHouse UK Ltd cannot be held responsible for any project over-runs, whatever the cause. Estimated project duration should be deemed to be 5 days from the date that cleared funds are received by AppHouse UK Ltd for the initial payment or by date confirmed in writing by AppHouse UK Ltd.
Payment
Payment of set up fees can be made by any major credit or debit card or company cheque. Payment will be debited and cleared from your account before the deployment of the service to you. By placing an order, you, the buyer, consent to payment being charged to your debit/credit card account or electronic payment account as provided on the order form.
Please note that AppHouse UK Ltd has appointed the BACS Approved Direct Debit Bureau, Eazy Collect Services Limited (www.eazycollect.co.uk), to collect your payments and Eazy Collect will be shown on your bank statement.
You will be charged the prices quoted for Products you have selected by direct debit on the 1st or the 15th of the month following you submitting your order to the company or representative. The Direct Debit will continue on a monthly basis. There is no minimum term contract.
It is your responsibility to promptly notify us of any changes to your billing information.
Returned Direct Debits will incur an additional fee of £10 per returned request. AppHouse UK Ltd reserves the right to consider an account to be in default in the event of a returned Direct Debit.
Copyrights and Trademarks
By supplying text, images and other data to AppHouse UK Ltd for inclusion in the customer's Application or other medium, the customer declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the customer, or rightful copyright or trademark owner.
Should AppHouse UK Ltd, or the customer supply an image, text, audio clip or any other file for use in an Application, or any other medium believing it to be copyright and royalty free, which subsequently emerges to have such copyright or royalty usage limitations, the customer will agree to allow AppHouse UK Ltd to remove and/or replace the file on the Application.
The customer agrees to fully indemnify and hold AppHouse UK Ltd free from harm in any and all claims resulting from the customer in not having obtained all the required copyright, and/or any other necessary permissions.
Rights of Refusal
AppHouse UK Ltd will not include in its Applications, any text, images or other data which it deems to be immoral, offensive, obscene or illegal. All material must conform to all standards laid down by all relevant advertising standards authorities. AppHouse UK Ltd also reserves the right to refuse to include submitted material without giving reason. Any images and/or data that AppHouse UK Ltd does include in all good faith, and then finds out that it contravenes these Terms and Conditions, the customer is obliged to allow AppHouse UK Ltd to remove the contravention without hindrance, or penalty. AppHouse UK Ltd is to be held in no way responsible for any such data being included.
Cancellation
Cancellation of orders may be made initially by telephone contact, or e-mail, however, following this, AppHouse UK Ltd will need formal notification in writing to the company's postal address. AppHouse UK Ltd will then have no further obligation to include your details in any future applications . Please note: any cancellation which is not formally confirmed in writing and received by AppHouse UK Ltd within 14 days of payment being over due, will be liable for the full payment overdue.
Privacy Policy
AppHouse UK Ltd values you as a customer and your right to privacy. Except as required by law, AppHouse UK Ltd will exercise commercially reasonable efforts to ensure that your personal information remains confidential and available only to AppHouse UK Ltd, and its employees, agents, and contractors. AppHouse UK Ltd will not sell your personal information to third parties.
Disclaimer
AppHouse UK Ltd makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. AppHouse UK Ltd will not be held responsible for any and all damages resulting from products and/or services it supplies. AppHouse UK Ltd is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold AppHouse UK Ltd responsible for any such loss or damage. Any claim against AppHouse UK Ltd shall be limited to the relevant fee(s) paid by the customer.
AppHouse UK Ltd reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions. AppHouse UK Ltd will not knowingly perform any actions to contravene these and the client also agrees to be so bound.
AppHouse UK Ltd Application advertising services are provided on as "AS IS", "AS AVAILABLE" basis, and AppHouse UK Ltd does not provide any assurances of the position that the Application will achieve within the respective app download store. AppHouse UK Ltd is not responsible for any Application availability, and dependent upon mobile provider service and the mobile device functionality.
AppHouse UK Ltd will endeavour to ensure all information advertised is correct and make amendments as and when changes come to the attention of AppHouse UK Ltd. However, AppHouse UK Ltd is not responsible for any inaccuracy or misstatement of any such information. You should read the information advertised and inform us of any amendments and bring to our attention any changes.
